Living Trusts

Is there anyone on the forum here who knows about Living Trusts? Long story short.... My mother-in-law passed away in dec 08. 4 days before she passed away, the niece showed up at the hospital with her attorney; and they had a new will and trust signed. It is creaating a nightmare for me, because of my wife. We are thinking of fighting this in court as the mother-in-law was not in her right mind when she signed it. The niece and my wife hate each other and my wife is the primary beneficiary, only the niece is exerting control over her in a real bad, decietful way. I figured I would put this out and see if there is anyone who can give me some pointers on where to start or if I am wasting my time. I just want the stress of it all gone!

Bubba,

The only dealing I ever had with a Living Trust was working with Mortgage Loans. A person puts their real property in someone else's name but retains the right to live in/on the property until their death and then it belongs to the person named in the trust.

You may have a chance if she was not in her right mind and maybe the Dr's and nurses witnessed it all. That said I am not an attorney. Find you a good one.

I don't have any real advice for you, except fight your nieces bullshit tooth and nail, even if no one wins but the lawyers. The niece should not benefit by her ubderhanded manipulation of your motherinlaw. Money is what drove her to these actions, so make damn sure she doesn't end up with any more that what your wife's Mom's wishes were before the niece pulled her sneaky manouver.

Bubba - this story sickens me :evil: I don't understand people that do these things. Fight Fight Fight! Hopefully the rush to get the trust before she died will be proof enough of her sneaky ways.

My folks have a trust and they did it for inheritance tax reasons. Susie Orman had written about the need for trusts.
